Reservation and Booking – Terms & Conditions

Regarding all courses, payment of the course fees does not guarantee certification. The student will be only certified when all certification-requirements are met.

All Jaguar Divers experiences require a medical questionnaire to be completed. In case of any doubt regarding your health conditions, Jaguar Divers will require a medical statement issued by a doctor (this can be arranged locally, on request). In cases of minors, this needs to be signed by a parent/guardian.

To participate in in-water activities you are required to show proof of certification for all non-entry-level experiences. Entry-level experiences and courses require a minimum participant age of 10 years. Some other courses and cenotes require a higher age to participate. If you are unable to provide proof of certification, you will not be able to dive and may forfeit all deposits paid.

You need to agree and sign the Liability Release and Assumption of Risk Forms before entering any in-water activities. In cases of minors, these need to be signed by a parent/guardian.

These terms will be applied fully and affect to your use of this website. By using this website, you agreed to accept all terms and conditions written here. You must not use this website if you disagree with any of these website Standard Terms and Conditions.

Minors or people below 18 years old are not allowed to use this website.

 

Modifications and Cancellation

You can change your booking date, subject to weather conditions and availability, given a 48 hours notice free of charge.

If you need to cancel for any reason, please notify us 48 hours prior to your booking for a full refund minus any transaction, wire, credit card, or PayPal fees. Notice given 24hrs before your booking will result in a no refund. The only exception for refunds is for course material costs, these cannot be refunded. 

For the periods between the 15th of December and the 15th of January, the cancellation notice is extended to 5 days before your booking activity. 

If then you fail to show or cancel less than 24 hours before your booking no refund will be given. We have a zero tolerance policy on drugs and alcohol, if any customer shows signs of being under the influence of drugs or alcohol, the experience will be cancelled and no refund will be made.

If you leave part way through your course no refund will be given.

 

Cancellations due to sickness or other medical conditions preventing clients from doing the activity: we would request a written statement from a doctor; in which case we will do everything possible to reschedule without extra cost. If rescheduling is not possible at that time, the client shall receive a full refund. 

 

 

Cancellation by the Company

All our activities are highly weather-dependent, and Jaguar Divers reserves the right in any circumstances to cancel the tour. In instances where Jaguar Divers cannot provide the tour booked, we will return to the client all deposits paid or Jaguar Divers may offer the client an alternative trip. If an alternative trip is refused by the client, Jaguar Divers retains the right to deduct the administrative cost resulting from such transactions.

 

Alterations to Itineraries

Although every effort is made to adhere to dive schedules and itineraries, Jaguar Divers reserves the right to alter dive schedules and itineraries at any time if it is in the client’s interest to do so or when forced by weather considerations.

Jaguar Divers will not be responsible for any compensation to the client if forced to cancel or in any way change trips due to force majeure, namely war, riot, civil strike, industrial dispute, terrorist activity, natural or nuclear disaster, fire, traffic congestion or any other external circumstances beyond Jaguar Divers control. 

 

Authority on Tour / Exclusion from Tour

The decision of the driver/ divemaster / instructor employed by Jaguar Divers will be final on all matters of safety. A client may be excluded from the trip/course without any refund of the trip/tour if their behavior is deemed unfit. If a client is unsuitable for a trip/tour, by our discretion we will cancel such client’s booking or decline to carry the client further if that client causes danger, inconvenience, or annoyance to other clients.

 

Digital Material

Clients should be aware that the team of Jaguar Divers may take photographs or films of the clients while on any of the tours and reserves the right to use such material for any advertising or brochure production without obtaining consent and without payment to the client.
