Terms & Conditions of Service
Please read these conditions before booking any dive, course or tour with Jaguar Divers.
Booking Conditions
For training courses, payment of the course fee does not guarantee certification. A student will only be certified once the criteria and standards of the certification level being taken have been met.
All Jaguar Divers diving experiences require a medical questionnaire to be completed. Should there be any doubt about the diver's health, JAGUAR DIVERS will require a medical statement issued by a doctor confirming that the person is fit to dive. This certificate can be obtained locally in Playa del Carmen if needed. If the diver is a minor, the certificate must also be signed by a parent or legal guardian.
To participate in our diving activities, except for all non-entry-level experiences, proof of certification must be presented. If it cannot be presented, diving will not be possible and no refunds will be issued.
Participants in Discover Scuba Dives, courses and guided dives must be over 10 years old. Some cenotes and advanced courses require a higher minimum age to participate.
A liability release and assumption of risk form must be signed before taking part in any water activity with us. For minors, this must be signed by a parent or legal guardian.
These terms apply and take effect when visiting our website. By using this website you consent to all the terms and conditions included here. You must not use this website if you disagree with any of these terms and conditions.
Persons under 18 years of age are not permitted to use this website.
Changes and Cancellations
You can change the date of your booking, subject to weather conditions and availability, with 48 hours' notice or more.
If you need to cancel for any reason, please notify us at least 48 hours in advance to receive a full refund (less any card or payment-processing fees). The exception to this rule is course materials, which cannot be refunded once they have been sent or delivered to the client.
If we are notified less than 48 hours in advance, no refund will be issued.
From 15 December to 15 January, the notice period for changes and cancellations increases to 5 days. If notice is given within a shorter period, no refund will be issued.
Exceptions to this policy can be made in some cases for medical reasons that prevent the client from carrying out the activity. In this case we will request a medical report and will try to reschedule the activity at no extra cost. If rescheduling is not possible, a partial/full refund will be issued depending on the situation.
We have a zero tolerance policy on drugs and alcohol, if any customer shows signs of being under the influence of drugs or alcohol, the experience will be cancelled and no refund will be made.
If you leave part way through your course no refund will be given.
Cancellations by the Company
All our activities depend heavily on weather conditions. JAGUAR DIVERS reserves the right to cancel or modify the tour when necessary. If it is impossible to deliver the contracted experience, JAGUAR DIVERS will issue a full refund or offer an alternative tour. Should the alternative activity not be accepted and a refund is issued, JAGUAR DIVERS reserves the right to deduct administration and processing costs from the amounts paid.
Changes to Plans
Although we make every effort to adhere to dive schedules and itineraries, JAGUAR DIVERS reserves the right to modify schedules and itineraries at any time if it is in the best interest of the client or when forced to by weather conditions.
JAGUAR DIVERS will not be obliged to issue a refund if the experience is cancelled due to demonstrations, riots, looting, war, terrorism, natural or nuclear disasters, fire, road closures, zombie apocalypse or any other force majeure beyond its control.
Tour Authority / Exclusion from the Tour
The decision of the driver/ divemaster / instructor employed by JAGUAR DIVERS will be final on all matters of safety. A client may be excluded from the trip/course without any refund of the trip/tour if their behaviour is deemed unfit. If a client is unsuitable for a trip/tour, by our discretion we will cancel such client’s booking or decline to carry the client further if that client causes danger, inconvenience, or annoyance to other clients.
Digital Material
Clients should be aware that the JAGUAR DIVERS team may take photos or videos during the tour. JAGUAR DIVERS reserves the right to use that material for promotional or advertising purposes without the written consent of the client.
Privacy Policy
Our privacy policy is quite simple. Under no circumstances will we sell or transfer your personal information (including first name, surname, email address or phone number). We will only occasionally send you promotional communications by email or WhatsApp.
Conditions for Training Courses
All courses must be paid in full on the first day of the course.
For training courses, payment of the course fee does not guarantee certification. A student will only be certified once the criteria and standards of the certification level being taken have been met. Safety is paramount for us, and not being able to dive safely at the end of the course is reason enough not to issue the certification.
eLearning: on courses with eLearning materials, self-study must be completed before the first day of the course. This helps us maximise time spent practising in the water. Where there is no digital manual, we will try to get printed copies to you well in advance.
The client is responsible for any damage caused to the equipment supplied during the course. The penalty will be the cost of replacing the damaged item.
We understand that sometimes a client may realise halfway through a course that diving is not for them. In that case there is no right to a refund.
